Act 115 (Removal of Government Members)

If the nation is concerned about the ability of the Prime Minister to lead the Austenasian Government, then he/she may be removed from office in accordance with Act 74, Law 8, Paragraph C.

The Prime Minister may not resign except with 6 months notice, and only if there is less than a year left until the next General Election. Once the Prime Minister resigns, an Acting Prime Minister will be appointed.

Representatives may not resign except with 6 months notice. Once a Representative resigns, they will be replaced with that Town’s Baron/Baroness until the next election. If the Baron/Baroness is below the age of 15, then a parent or legal guardian of the Baron/Baroness will become the provisional Representative. [This law has been changed – see Act 123, Law 5]

If a Town is concerned about the ability of their Member of Cabinet in representing their interests in Parliament, then he/she may be removed from office in the following way:

1. More than 65% of that Town’s Council must vote for the removal from office of the Representative.

2. More than 50% of all Subjects in that Town must vote for the removal from office of the Representative.

3. If less than 60% of all Subjects in that Town voted for the removal from office of the Representative, then the Prime Minister must give his/her disapproval against the Representative.

4. If the conditions in Paragraphs A-C of this same Law are met, then the Baron/Baroness of that Town will become that Town’s Representative until the next election. If the Baron/Baroness is below the age of 15, then a parent or legal guardian of the Baron/Baroness will become the provisional Representative.

If a Representative is placed under arrest for treason, regicide, high treason, or rebellion, then they will immediately lose the office of Representative. The Prime Minister will then appoint somebody to act as Representative for that town until the next election.

If the leader of a Government Ministry (Home Secretary, Chief Ambassador, Chancellor, Minister for the Environment, Minister of Defence etc) or the Secretary-General wishes to resign, then they may only do so with 2 months notice.

The leader of a Government Ministry (Home Secretary, Chief Ambassador, Chancellor, Minister for the Environment, Minister of Defence etc) or the Secretary-General may only be removed from that office if the Prime Minister and more than 50% of the Cabinet votes for it. They shall still remain a Representative, and the Prime Minister shall choose their successor out of the Cabinet.

If the Empire of Austenasia is at war, then Law 7 if this same Act will not apply for the removal of the Minister of Defence from that office. If Austenasia is in a state of war, then the Minister of Defence may be removed from that office if both the Monarch and Prime Minister vote for it. The Prime Minister shall choose the next Minister of Defence out of the Cabinet.
