LXXIII Jon. I 2017 (Bribery)

The purpose of this Act is to make new provision for the definition and prohibition of bribery, as well as to approve the Imperial Decree of HIM Emperor Jonathan I numbered XXIX.

Paragraph 1, Subsection G of the Third Imperial Decree of HIM Emperor Declan I is hereby repealed.

The misdemeanour of bribery is committed when a person either:

1. Gives, offers, or promises an advantage of a financial or some other nature to another individual in exchange for improperly performing a function or activity as defined in Paragraph 4 of this same Act.

2. Requests, accepts, or agrees to accept an advantage of a financial or some other nature from another individual in exchange for improperly performing a function or activity as defined in Paragraph 4 of this same Act.

In regards to Paragraph 3 of this same Act, a function or activity which can be improperly performed for the purposes of bribery covers any function of a public nature; any activity connected with a business, trade or profession; any activity performed in the course of a person’s employment; or any activity performed by or on behalf of a body of persons whether corporate or unincorporated, with the condition that the person performing the function or activity would be expected to be performing it in good faith or with impartiality, or that an element of trust is attached to that person’s role.

In regards to Paragraphs 3 and 4 of this same Act, a function or activity for the purposes of bribery is performed improperly when the expectation of good faith or impartiality has been breached, or when the function or activity has been performed in a way not reasonably expected of a person in a position of trust.

As an addendum, in accordance with Article IV, Section D, Paragraph C of the Austenasian Constitution of 2011, the House of Representatives hereby grants its approval and consent to the Imperial Decree of HIM Emperor Jonathan I numbered XXIX (decreed 27 February 2017), thereby making it permanent law. In accordance with said Imperial Decree, IV Dec. I 2011 (Era Names) is hereby repealed.
