CXLIX Jon. I 2020 (Territories)

The purpose of this Act is to compile in a single Act the current powers, duties, rights and responsibilities of Governors; to provide for their appointment and replacement; to appoint James Braidwood as Governor of Campo del Sol; and to approve the Imperial Decree of HIM Emperor Jonathan I numbered XLVI.

Governors are charged with enforcing the law, maintaining public order, and preventing and investigating crimes which take place in their respective Territories. As such, in accordance with Paragraphs 5 and 8 of XIII Jon. I 2013 (Police), Governors have the authority to arrest suspected criminals and to recruit police officers. Furthermore, Governors:

1. are responsible for ensuring that no exiled persons or banned or prohibited items enter their Territory;

2. may choose which optional public holidays – such as those listed in Paragraph 10 of XVI Jon. I 2014 (Public Holidays) or Paragraph 7 of LXXVI Jon. I 2017 (State Religion) – are officially observed in their Territory;

3. may – with the approval of the Monarch – veto a designation by the Minister for Culture of a national monument within their Territory, and must agree to the charter for any national monument designated within their Territory;

4. may choose to claim ownership on behalf of their Territory of any treasure or removable fossils discovered therein;

5. may order restrictions (whether temporary or indefinite) on controlled flight – whether manned or unmanned – of any aircraft or aerial vehicle operated by an Austenasian subject or resident within their Territory;

6. may forbid or regulate the consumption and/or sale of alcohol in areas which are public property within their Territory; may legalise the importation, possession, production, sale and/or purchase of any Class B drugs within their Territory; may prohibit the sale and/or purchase, the production, and the possession of tobacco and/or nicotine and products containing it within – as well as the importation of the same into – their Territory; and may prohibit all consumption of tobacco and/or nicotine within their Territory;

7. may make a seizure of property within their Territory in accordance with the provisions of CXLIII Jon. I 2020 (Seizures);

8. may recruit a regiment of Limitanei in accordance with the provisions of CXLIV Jon. I 2020 (Armed Forces);

9. must give permission for and supervise any conveyance of explosives through their Territory in peacetime;

10. may authorise the use of the Julian calendar within their Territory so long its use is specified, and may use the Julian calendar for official purposes on the condition that the corresponding Gregorian dates are also given and that it is specified to which each date belongs; and

11. may declare a local state of mourning in response to tragedies specifically applicable to their Territory; and

12. may veto an allocation of arms to their Territory by the Chief Herald.

Following the precedent set by Paragraph 6 of CXLVI Jon. I 2020 (Nobles) concerning the equivalence of Territories to Towns in regards to relevant clauses of the Austenasian Constitution of 2011, Section C of Article VIII of the same shall be interpreted as allowing Governors to pass bye-laws for their Territories in an equivalent manner as Town Councils do so for Towns, in order to allow them to exercise their powers and duties as specified by Paragraph 2 of this same Act and any applicable subsequent legislation. Should this be considered in breach of the wording of Article VIII, Section C of the Austenasian Constitution of 2011, then bye-laws passed by Governors may be considered legally distinct from bye-laws passed by Town Councils.

Governors may where necessary delegate any or all of the powers and duties specified in Paragraph 2 of this same Act, as well as the ability to exercise such by the passage of bye-laws, to one or more Deputy Governors.

A Governor shall where possible be appointed to a Territory by the legislation that annexes it. Should a Territory be without a Governor, an individual shall be appointed to the position by Act of Parliament or by Imperial Decree. If by the latter, and the House of Representatives votes to rescind said Imperial Decree, then the Governor appointed by such shall have been in office from the passage of the Imperial Decree until its rescinding.

James Braidwood is hereby appointed Governor of Campo del Sol upon the resignation from said office of Lady Sophia Albina, Countess of Nova Albion.

As an addendum, in accordance with Article IV, Section D, Paragraph C of the Austenasian Constitution of 2011, the House of Representatives hereby grants its approval and consent to the Imperial Decree of HIM Emperor Jonathan I numbered XLVI (decreed on 1 August 2020), thereby making it permanent law.
